Welcome to The MedicAlert Foundation Terms and Conditions for use ("Terms and Conditions"). Please read these Terms and Conditions carefully. These Terms and Conditions apply to the use of our Service, our Goods, this Website and Your MyMedicAlert account, By accessing this Website, , registering for a MyMedicAlert account and/or placing an Order, You agree to contract with us and be bound by the Terms and Conditions set out below.
MedicAlert have 3 services which have specific terms within these terms and conditions. Please refer to the below clauses depending on your type of membership with us:
For STANDARD MEMBERSHIP please see clauses 1 –5 inclusive. In the event of any conflict between the provisions of these terms, clauses 1 to 5 (inclusive) shall take precedence over all other provisions for members holding a Standard Membership.
For HERBERT PROTOCOL TERMS AND CONDITIONS please see clauses 6 - 9 inclusive. In the event of any conflict between the provisions of these terms, clauses 6 to 9 (inclusive) shall take precedence over all other provisions for members holding a Herbert Protocol.
LIFETIME MEMBERS – SERVICE NO LONGER OFFERED FOR NEW MEMBERS please see [https://www.medicalert.org.uk/lmtc/].
If You do not agree to be bound by these Terms and Conditions You may not:
create a MedicAlert Account or a Herbert Protocol;
access or change Your data through our Website;
use our Service; or
purchase our Goods.
The MedicAlert Foundation has the right, in its sole discretion, to add to, remove, modify or otherwise change any part of the Terms and Conditions, in whole or in part, at any time to reflect changes in relevant laws and regulatory requirements or make minor technical adjustments and improvements. These are changes that don’t affect Your use of the Goods and Services. Changes will be effective when notice of such change is posted at this Website. Please check the Terms and Conditions frequently for updates by checking the date of "Last Update" at the top of this document. If any term, condition or any change thereto is not acceptable to you, You must discontinue Your Use of this Website or our Service immediately. Your continued Use of this Website after any such changes are posted will constitute acceptance of those changes.

Definitions
In these Terms and Conditions, the following words have the following meanings:
“Active Acceptance” means Your indication on the Order Form (in whatever format the Order Form is submitted) of Your acceptance of the Contract;
“Advocate” means the person identified on the Order Form as being an individual who:
has the proper permission from the Member or the legal right to sign up to a MedicAlert account on the Member's behalf;
has the Member's permission to discuss and share their Personal information with us; and
has the Member's permission to update or change their Personal Information with and/or to Us;
“Authorised Representative” means the person identified on the Order Form as being either:
the parent of a Minor or guardian of a Vulnerable Member; and/or
a person acting under a lasting or enduring power of attorney on behalf of a Vulnerable Member; and/or
a professional with a duty of care to a Vulnerable Member;
“Contract” means any contract between You and Us for the provision of the Service and/or Goods;
“Disc” is a type of personalised Good and means any item to be engraved with Your main medical conditions as disclosed to Us pursuant to the process outlined in these Terms and Conditions, Your Membership Number and the telephone number of our Emergency Service;
“Emergency Service” means the provision by Us of access to an emergency telephone helpline accessible 24 hours a day, every day of the year, through which people (typically clinical and emergency professionals) can access the Personal Information You provided to Us;
“Controller, data controller, processor, data processor, data subject, personal data, processing and appropriate technical and organisational measures” have the same meanings as set out in UK GDPR;
“Force Majeure Event” means any event or circumstance beyond a party's reasonable control;
“Goods” means any products ordered by You from Us or to be supplied by Us to You including but not limited to Discs, Sports Bands, Activity Bands, Wristband Tags, Bracelets and Necklaces;
“Lapsed Phase” means a period of time, as set out at clause 7 and sub-clause 16.4, where the Member's Personal Information is held on Our system and is made available to the Emergency Service;
“Member” means the person identified on the Order Form applying for membership of The MedicAlert Foundation;
"Lifetime Membership" has the meaning afforded to it by clause 25
“Membership Number” means the unique identification number assigned by Us to You to identify You in our records;
“Minor” means a Member who is under the age of 18 years;
“Offer” means the proposal from Us to You for Goods and/or Service based on Your Order;
“Order” means the request by You from Us for Goods and/or Service;
“Order Form” means the form (paper or electronic) containing details of the Order placed by You with Us for the provision of the Service and/or Goods;
“Permitted Recipients” means the parties to this agreement, the employees of each party, any third parties engaged to perform obligations in connection with this agreement;
“Personal Information” means any information relating to You and / or the Member who can be identified, directly or indirectly, in particular by reference to an identifier such as name, gender, date of birth, residential address, telephone number, details about the Member's medical condition. Such medical details may encompass specific diseases, illnesses, allergies, any implants Member's may have, medications they are taking, and their preferences for medical treatment. Additionally, it includes any documents you have submitted to us.
“Privacy Policy” means our policy for use of the Member’s Information as indicated within the Privacy Notice displayed here; https://www.medicalert.org.uk/Privacy-policy/
“Service” means the service set out at clause 2;
“Standard Membership” means the main Service that MedicAlert provides to all paying or funded members as further detailed at clauses 1 and 2;
"The Herbert Protocol" means the national scheme to help make sure that people living with dementia who are at risk of becoming lost can be found and brought home safely as detailed further here https://herbertprotocol.com/;
"UK GDPR" means Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, as it forms part of the law of England and Wales, Scotland and Northern Ireland by virtue of the European Union (Withdrawal) Act 2018;
“Vulnerable Member” means a Member who is either:
unable to give their informed consent; and/or
is mentally or physically incapacitated in some way that prevents them from entering into this Contract themselves;
“We”/ “Us” / “Our” means The MedicAlert Foundation (registered charity number 233705, Company No. 814000 registered in England & Wales) whose registered office is Suite 1, Liscombe South, Liscombe Park, Soulbury, LU7 0JL “Website” means www.medicalert.org.uk “You” / “Your” means the person entering into this Contract with Us who may become either:
the Member; or
the Advocate of a Member; or
an Authorised Representative of the Vulnerable Member.

Standard Membership Order
1.1 When You apply to Us for a MedicAlert membership, an Order Form will be completed (either by You or by Us on Your behalf) with the Personal Information You provide to Us.
1.2 By completing the Order Form (online, over the phone or via post) You will be deemed to have provided Active Acceptance of these Terms and Conditions and by doing so You will be deemed to have entered into a legally binding Contract with Us which incorporates these Terms and Conditions, the terms set out in the Order Form and the Privacy Policy.
1.3 If You place Your Order over the telephone, You will receive an email or letter from Us confirming Your Order and providing access to the Terms and Conditions. They are also available on Our Website. You will have 48 hours from receipt of those Terms and Conditions to notify us if You do not accept them. If You notify us that You do not accept those Terms and Conditions, then the Contract will be cancelled without any liability to Us or You.
1.4 We may refuse at Our sole discretion to:
1.4.1 accept any Order from You or
1.4.2 make an Offer to You.
1.5 Once we have received Your Order it may be reviewed by a Registered Nurse as required to provide guidance on what should go on the Disc
Standard Membership Service
2.1 MedicAlert Members create an account on Our Website, populating it with your Personal Information. MedicAlert member have the option to Purchase a Good but must purchase a MedicAlert membership to benefit from our Service.
2.2 Where there is a medical issue concerning the Member, any clinical or emergency professional, anywhere in the world, may call the telephone number of the Emergency Service displayed on a Disc. We will verify the Membership Number on the relevant Disc and confirm the caller's identity to Our satisfaction. Emergency professionals may enquire if someone is a member by providing a subset of information (which could include name, date of birth and a postcode).
2.3 We will release Personal Information about the Member as We deem appropriate to assist with medical treatment or render other support. We may call Advocates, Authorised Representatives, other contacts listed on your MedicAlert account and/or 999 in the event of an emergency, if We deem appropriate.
2.4 By entering into this Contract, You give Your consent to Your data being shared outside the EU for the purposes set out and in accordance with the Privacy Policy.
Standard Membership - What You need to do to receive the Service and/or the Goods
3.1 We may discuss with and receive updates and amendments from You and/or any Advocates in respect of the Personal Information We hold. We and/or You may at any time revoke the status of an Advocate by written notice to Us. If there is more than one Advocate, any Personal Information can be amended by any Advocate recorded on Your Order Form.
3.2 If there is a discrepancy in the Personal Information provided, We will be entitled to ignore such Personal Information until We are able to verify it with:
3.2.1 You and/or
3.2.2 a professional with a duty of care and as notified to Us by You.
3.3 By entering into a Contract, You give Your consent to the Personal Information being used and released in accordance with these Terms and Conditions and Our Privacy Policy.
3.4 You understand that the Personal Information You provide to Us can be critical in the event of an emergency and the need to Use our Service. You also understand We can only rely on You to ensure that the Personal Information is accurate, up-to-date, complete and truthful. In providing Your Active Acceptance (and any time thereafter when You contact Us to update Your Personal Information or place a new Order), You agree that the Personal Information You provide Us will at all times be a truthful and accurate record of the Personal Information You wish to be disclosed to a clinical or emergency professional in the event of an emergency and You acknowledge that We and any clinical or emergency professional to which the Personal Information is disclosed are entitled to rely on such Personal Information.
3.5 If requested by Us, You will check all Personal Information held by Us and will inform Us immediately of any error in or changes to the Personal Information held by Us. You will be able to request a print out of Your data at any time. .
3.6 You are responsible for ensuring that the Personal Information held by Us about the Member is complete, accurate and up to date and You will advise Us promptly of any changes to the Personal Information. You acknowledge that it is Your responsibility to keep the Member’s Personal Information up to date and that Your failure to do so can result in Us not being able to provide accurate information on the Member when the Emergency Service is called.
3.7 As a minimum You will check the Personal Information annually, at renewal, and let Us know if there are any changes required.
3.8 The Member will be the only person who wears the Disc. We advise the Member should only wear the Disc when all Information is accurate.
3.9 If the Member does not wear the Disc, this may delay the provision of emergency medical treatment to the Member, since medical or clinical emergency professionals may not be able to identify the Member’s medical condition so readily. The Member acknowledges this and assumes all risks in this regard.
3.10 If a person is acting as an Authorised Representative for a Vulnerable Member, We assume that the Authorised Representative has the proper permission or legal right to act on behalf of the Vulnerable Member.
3.11 If You designate an Advocate, We will assume that You have given Your consent to such person to act on Your behalf.
3.12 If You are provided at any time with the ability to access Your personal details and medical records via the Website then You will be provided by Us with a login and password. You undertake that You will not share this with anyone else. In agreeing to access Your details on the Website You also agree to receive all Your member communications via email. You will have the option to also receive marketing information if You choose to.
Standard Membership Price and payment
4.1 The price for the Goods (including delivery charges and VAT) and the annual membership fee for the Services will be as set out on the Order Form. The annual membership fee for the Services will be payable on each and every anniversary of the date on which the Contract was first entered into. We shall be entitled to increase the annual membership fee for the Services at any time by giving You notice of such increase at least 3 months prior to the date on which the next annual membership fee becomes due.
4.2 The annual membership fee can be paid by Direct Debit or another payment method available at the time of renewal.
4.3 You will need to make payment for the Goods and the Services in pounds sterling or euros (as indicated) at the time You return the signed Order Form to Us, or at the time You provide payment details over the telephone, or make payment online at the time You submit Your Order Form.
4.4 We will only deliver the Goods or provide the Service once We have received payment in full and cleared funds.
4.5 The Advocate for a Minor or Vulnerable member may pay the annual membership fee providing they provide a billing address and contact details.
4.6 If You fail to pay the annual membership fee, We shall be entitled to terminate the Contract, insofar as it relates to the Services and any Goods which have not been delivered to you, with immediate effect and You will no longer have access to the Emergency Service. If You are unable to pay because of financial or other difficulties, sponsorship may be available. Contact us if required.
Standard Membership Delivery
5.1 We aim to dispatch the Goods to the address You provided on the Order Form within 10 working days of receipt of Your Order Form.
5.2 You will become the owner of the Goods when they have been delivered to Your chosen delivery address. Once Goods have been delivered to You, they will be held at Your own risk and We will not be liable for their loss, normal wear and tear or destruction.
5.3 You will check Your Disc upon delivery and will inform Us immediately should there be an error in the wording of Your Disc.
Herbert Protocol Registration and Use of the Service
You may register for the Herbert Protocol service by completing the required form on Our Website located HERE.
By submitting the form, You confirm that the provided information is accurate, complete and up to date and that you have read, accept and understand these Terms and Conditions.
Herbert Protocol users are not required to pay a membership fee. However, optional goods can be purchased by upgrading to ‘Standard Membership’, which would make the MedicAlert Membership Terms and Conditions applicable.
The information provided in the Herbert Protocol form is stored securely and shared only with emergency services when necessary to assist in locating a missing person.
Herbert Protocol Data Retention and Lapsed Phase
Herbert Protocol records, containing your Personal Information remain active for 1 (one) year. If consent to retain information is not renewed after this period, the record will enter a Lapsed Phase for six months, during which time the record will continue to be available to emergency services.
If consent is not renewed during the Lapsed Phase, all associated Personal Information will be permanently deleted from our system and the record will not be available to emergency services. This contract will be terminated if We have not received Your consent to continue holding Your Personal Information within this six (6) month Lapsed Phase. You may request deletion of your Herbert Protocol data at any time by contacting us at info@medicalert.org.uk.
Herbert Protocol Responsibilities and Limitations
MedicAlert does not guarantee that emergency services will access or use the Herbert Protocol data in every instance of a missing person incident.
MedicAlert shall not be liable for any loss, injury or damages resulting from the failure to locate a missing person despite the use of the Herbert Protocol.
Personal Information may be shared with emergency services when deemed necessary to locate a missing person. By using the Service, you consent to data sharing as set out in these Terms and Conditions and the Privacy Policy.
Herbert Protocol Third-Party Account Creation
If you are creating an account on behalf of another individual, such as a vulnerable adult or someone unable to manage their own account, you confirm that:
the information provided is up-to-date and accurate;
You have the legal authority to act on their behalf, such as legal guardianship or another lawful basis;
You will provide accurate and truthful information about the individual for whom the account is being created;
You will manage the account in the best interests of the individual and in compliance with these Terms and Conditions where you have created an account on their behalf; and
the individual for whom the account is created has consented to the use of their Personal Information, and has understood or been informed of the purpose of the MedicAlert membership.
Right to Request Documentation
MedicAlert reserves the right to request additional documentation or evidence to verify your authority to act on behalf of another individual for MedicAlert Memberships and the Herbert Protocol. However, MedicAlert will not routinely require such documentation unless necessary for legal or regulatory purposes.
Warranty for the goods
We guarantee that the Goods will be free from any material defects (including errors caused by us on the Disc) for:
3 months for all beaded Goods;
6 months for the following types of Goods: Sports Bands, Activity Bands, Wristband Tags and Athena Leather Bracelets; and
12 months for all other jewellery
The warranty is effective from the date of despatch.
If the Goods have a defect within this period, We can choose to either replace or repair such Goods.
The warranty does not cover: repairs made by anyone other than our skilled jewellery team; Goods damaged from everyday wear and tear; tarnishing of silver; scratching of the disc, chain and attachments; damage resulting from misuse or accidental handling; lost/misplaced Goods ; and changes in engraved information after engraved Good is approved.
Your statutory rights are not affected by this guarantee.
Our liability to you
Nothing in these Terms and Conditions shall limit or exclude Our liability for:
death or personal injury caused by Our negligence, or the negligence of Our officers or employees;
fraud or fraudulent misrepresentation; or
any matter in respect of which it would be unlawful for Us to exclude or restrict liability.
Our total liability to You in respect of the Services, whether arising in contract, tort (including negligence), breach of statutory duty and/or breach of common law and/or any other legal basis shall not exceed the amount paid by You to Us under this Contract.
Subject to sub-clause 12.1, neither Us nor You will be liable to the other, whether in contract, tort (including negligence), breach of statutory duty or otherwise, for any indirect or consequential loss arising under or in connection with this Agreement.
We shall not have any liability to You and/or any third party as a result of the provision of any incorrect Personal Information given to Us; any failure by You to notify Us of any changes in the Personal Information and/or Your failure to wear the Disc; any failure by a clinical or emergency professional to
find the Disc on You; or
call Us with the correct Membership Number.
Data protection
Details of Our approach to data security and personal data privacy are detailed in the Privacy Policy, which may be updated as and when required by Us. The Privacy Policy is available here: https://www.medicalert.org.uk/Privacy-policy/
For the purposes of UK GDPR we are the Data Controller.
Force majeure
Neither party shall be in breach of this Contract nor liable for delay in performing, or failure to perform, any of its obligations under this Contract if such delay or failure result from a Force Majeure Event.
Cancellation of Orders and refunds
For most of Our Goods and Our Service, You have a legal right to change Your mind about Your purchase and receive a refund of what You paid for it. This is subject to some conditions, as set out below.
Subject to paragraph 10.3, You can refund your Order provided:
it is not a personalised Good, such as a Disc and You inform Us no later than fourteen (14) days after We deliver Your Goods; or
you inform us no later than 14 days after you have paid for the MedicAlert membership and you have not contacted the Emergency Service number.
YOU ACKNOWLEDGE AND AGREE THAT BY CONTACTING THE EMERGENCY SERVICE NUMBER, YOU FORFEIT ANY RIGHT TO REFUND OR CANCEL THE SERVICE UNDER THIS CONTRACT. ONCE THE EMERGENCY SERVICE NUMBER IS CONTACTED, THE SERVICE IS CONSIDERED COMMENCED, AND YOU WAIVE ANY CANCELLATION RIGHTS THAT MAY OTHERWISE HAVE BEEN AVAILABLE. YOU ACKNOWLEDGE AND ACCEPT THAT YOU LOSE ANY CANCELLATION RIGHTS.
Your right to cancel an Order is also waived when:
Goods sealed for health protection or hygiene purposes, are unsealed after You receive them; or
Goods are personalised to Your specifications such as Discs.
Each Disc is custom made for each Member. We cannot, therefore, refund You for the Disc if You change Your mind or decide to cancel Your Order.
You are responsible for ensuring that Your Good is ordered in the correct size and style. If You later choose to request a size adjustment or change of wording for Your Disc, You will pay the associated adjustment, Disc replacement and postal charges.
For Orders You want to return that fall outside of the prohibitions at sub-clauses 15.2 and 15.3, please contact our membership service department. The returnable items must be new, unworn and in original packaging. You are responsible for all return postage.
Refunds will be processed promptly and without undue delay, typically within 14 days from the date the return is received. Refunds will be issued using the original method of payment, unless the consumer opts for store credit.
Termination
We may immediately terminate this Contract by written notice if:
You fail to make any payment when due; a
You breach these Terms and Conditions or any other terms which form part of the Contract (and, if remediable, the breach has not been remedied within 14 days of receiving notice requiring it to be remedied), including, for the avoidance of doubt, if You provide any inaccurate Personal Information; and/or
the information on your medical record or the Herbert Protocol record is found to be inaccurate, misleading, or no longer relevant.
You may terminate this Contract on written notice to Us at: Suite 1, Liscombe South, Liscombe Park, Soulbury, LU7 0JL or email on info@medicalert.org.uk . We shall remove Personal Information from Our records provided that: (a) You request termination of this Contract in such form as We require from time to time; (b) The Member shall no longer wear and shall return and/or destroy all Discs; and (b) We shall have no liability to You and/or any third party resulting from Our removal of Personal Information at Your request; (c) You acknowledge that in the event of termination of this Contract, and in particular should You continue to wear the Disc, We have no duty to You, as to the provision of the Emergency Service or the maintenance of the Member's Personal Information.
Following termination of the Contract, we would advise that the Member should no longer wear the Disc as this may cause confusion in the emergency. We would advise that it is destroyed or returned to us. For similar reasons, we would also recommend that no-one other than the Member should wear the bracelet.
MedicAlert memberships: If we fail to receive payment for the MedicAlert Account membership, the MedicAlert Account record will enter a Lapsed Phase as we no longer have the Member's consent to pass this information on. It will stay in this Lapsed Phase for a period of six (6) months and then the Member's record containing the Member's Personal Information will be deleted and this contract will be terminated if We do not receive payment for the Member's MedicAlert Account membership. You can request to remove the Member's data at any time during the Lapsed Phase. For more information please read our Privacy Policy where You can see our full data retention policy.
When a Minor Member reaches the age of 18 years We will contact the Member and offer to enter into a new contract with them in their own capacity. Notwithstanding termination of the Contract in such circumstances, We will keep the Personal Information We have at the time on the Member until such time as the Member contacts Us.
Intellectual property and right to use
You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in the Goods and/or the Services, or in all or any material or content supplied as part of the Website, shall remain at all times vested in us or our licensors. You are permitted to use this material only as expressly authorised by us or our licensors.
You acknowledge and agree that the material and content contained within the Website is made available for Your personal non-commercial use only and that You may (if necessary to make a Purchase) download such material and content onto only one computer hard drive for such purpose. Any other use of the material and content of the Website is strictly prohibited. You agree not to (and agree not to assist or facilitate any third party to) copy, reproduce, transmit, publish, display, distribute, commercially exploit or create derivative works of such material and content.
Third party links
To provide increased value to our Users, we may provide links to other websites or resources for You to access at Your sole discretion. You acknowledge and agree that, as You have chosen to enter the linked website we are not responsible for the availability of such external sites or resources, and do not review or endorse and are not responsible or liable, directly or indirectly, for (i) the privacy practices of such websites, (ii) the content of such websites, including (without limitation) any advertising, content, products, goods or other materials or services on or available from such websites or resources or (iii) the use to which others make of these websites or resources, nor for any damage, loss or offence caused or alleged to be caused by, or in connection with, the use of or reliance on any such advertising, content, products, goods or other materials or services available on such external websites or resources.
Notices
Any notice given to a party under or in connection with the Contract shall be in writing and shall be delivered by hand or by pre-paid first-class post or other next working day delivery service at its registered office (if a company) or its principal place of business (in any other case);
Any notice shall be deemed to have been received:
if delivered by hand, on signature of a delivery receipt; and
if sent by pre-paid first-class post or other next working day delivery service, at 9.00 am on the second Business Day after posting.
This clause does not apply to the service of any proceedings or other documents in any legal action or, where applicable, any other method of dispute resolution.
Safeguarding
In line with Charity Commission guidance, MedicAlert has a Safeguarding Policy in place to protect our members and staff.
Charitable Communications
By entering into this Contract to be a member of the MedicAlert Foundation, You give Your consent that MedicAlert may send communications (emails or postal) regarding MedicAlert’s fundraising activities and charitable projects.
Third party rights
Unless it expressly states otherwise, the Contract does not give rise to any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of the Contract.
Governing Law
The Contract and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with it or its subject matter or formation shall be governed by, and construed in accordance with the law of England and Wales.
Jurisdiction
Each party irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with the Contract or its subject matter or formation.
